Navigating the red tape
While preparing the paperwork might be a hassle, knowing what documents needs to be used can help ease moving pains.
Having trouble understanding what paperwork needs to be filled in before an employee can go on an overseas assignment? Cartus decodes some of the red tape and documents an assignee would need in order to obtain a work permit.
Hong Kong
- For new employment visa applications at the time of submission, the applicant must be physically out of Hong Kong.
- Applicants are not allowed to commence work unless all relevant immigration paper work has been completed and fully approved by the Hong Kong Visa & Immigration Department.
- After submitting all required documentation to the Immigration Department, visa(s) can be expected to be approved in approximately four to six weeks.
Employment Visa (For transferee):
- Completed Application Form 990A from the Immigration Department
- Two (2) passport-sized pictures
- A copy of passport
- A copy of highest educational degree
- A CV
- A copy of the detailed and up-to-date job description of candidate’s job position in Hong Kong
- A copy of a reference letter from previous or current employer
Dependent Visa (for spouse/each child):
- Completed Application Form 990A from the Immigration Department
- A copy of dependant’s passport
- A copy of main applicant’s passport
- A copy of marriage/birth certificate(s)
- Two passport size photos
Information to be supplied by sponsor (company):
- Application Form 990B
- A copy of mutually signed employment contract
- A detailed and up-to-date job description
- A copy of business Registration
- A copy of certificate of Incorporation (if any)
- Financial Report/Audit Report (the latest three years)
- Updated staff list (Include staff names, positions, date of joining and approximate salaries)
- A letter to represent your company and its employees for all visa and immigration services (attached)
- Additional documents are required for newly established company.
Vietnam
- To obtain a Work Permit, the sending company overseas prepares an assignment letter which provides an estimate of the date when the employment contract with the receiving company in Vietnam will be signed.
- The work permit must be sponsored by a locally registered entity.
- Once all the document requirements are complete, a Work Permit application is prepared and filed with the Labour Department of the province employee is assigned. The Labour Department processes and approves the application.
- The validity of the Work Permit is based on the length of the assignment provided in the employment contract, which can be up to a maximum of three years.
- All documents that are not in Vietnamese must be translated, notarized and cetified by the Vietnamese Embassy/Consulate in the foreign national’s home or host country. In order for a foreign sourced document to be translated and certified in Vietnam, it must first be legalised by both an agency of the Ministry of Foreign Affairs in the foreign national’s country or the equivalent agency and the Vietnamese embassy or consulate in that country. The legalisation may also take place at the embassy or consulate of the foreign national’s country in Vietnam.
- It takes 15 to 20 working days from the application date to obtain the work permit
Requested documents:
From the employer:
- Work Permit application form signed by the employer
- Copy of the employer’s Certificate of Business Registration or License
From the employee:
- Work permit application form signed by the employee
- Original education documents attesting to foreign employee’s skills and knowledge
- Original Police Certificate or Certificate of Good Conduct from relevant authority from which the assignee last resided
- A curriculum vitae
- Four 3x4cm photographs for each applicant
- A health certificate issued by a Vietnamese medical establishment or a medical establishment of the country in which the foreign employee is a citizen.
International assignees typically enter Vietnam with a three month business visa and once they hold a work permit, they will be able to renew the visa. The validity period of Business Visas can range from three months up to a year. Work permit, marriage and birth certificate are required to foreign employees and their dependents for obtaining this visa.
After a certain time in the country (six to 12 months depending on the location), assignee and dependents are eligible for a Resident Permit, which is equivalent to a multiple entries business visa with the advantage of being valid for the duration of a work permit (three years). The resident permit is not compulsary.
