Can Malaysia employers pay lower than minimum wage if the employee agrees? No, confirms MOHR

"This is against the law," clarified Malaysia's Ministry of Human Resources (MOHR) on the minimum wage rules, which came into effect on 1 May 2022. 

Malaysia's MOHR (Kementerian Sumber Manusia, or KSM) has released a new infographic clarifying the penalty framework for employers who are convicted for offences related to the Minimum Wage Order that came into effect on 1 May 2022.

As such, it has affirmed that employers cannot pay a basic wage amount that is lower than the minimum wage, even if their employee/s agree to such an arrangement, as that would be against the law.

All penalties for the various offences linked to the Minimum Wage framework are listed in the table above (in Malay), and in the table below (in English):
