Indonesia declares Tripartite commitment to preventing and dealing with sexual violence at the workplace

The government, employers, and employees will work together on efforts to prevent such acts, handle the recovery of victims, and establish a task force under new regulations, among other initiatives.

Indonesia's labour stakeholders — consisting of the government, employers, and employees — have declared a Tripartite commitment to prevent and deal with sexual violence in the workplace.

Present at the declaration on 1 June 2023 (Thursday), Minister of Manpower Ida Fauziyah remarked: "This joint declaration is very important because the success of preventing sexual violence in the workplace can be realised if there is the same commitment and perception from industrial relations representatives." 

Minister Ida also affirmed the importance of this declaration in supporting the implementation of the latest regulations on the matter — namely the Decree of the Indonesian Ministry of Labour Number 88 of 2023 (Keputusan Menaker, or Kepmenaker, Nomor 88 Tahun 2023), concerning the prevention and handling of sexual violence in the workplace.

The scope of the Decree covers matters related to sexual violence in the workplace, including:

  • efforts to prevent sexual violence in the workplace;
  • complaints, handling, and recovery of victims of sexual harassment and violence in the workplace; and
  • the formation, functions, and duties of the Task Force for the Prevention and Handling of Sexual Violence in the Workplace.

In a speech at a separate event, Minister Ida called on companies to strengthen commitments to prevent sexual harassment in the work environment. This would mean the imposition of sanctions and disciplinary action through company policies and labour agreements, company regulations, and joint labour agreements.

Meanwhile, Chairman of the Indonesian Employers' Association (APINDO), Hariyadi B. Sukamdani, added that as a forum for the business world, APINDO appreciates and welcomes the issuance of the Kepmenaker Number 88 of 2023.
