The law will ensure equal rights for all couples, including mutual support and inheritance rights.
Thailand is set to implement its Equal Marriage Law on 23 January 2025 (Thursday), following the Cabinet's approval of key amendments to the Family Registration Act.
These changes introduce gender-inclusive language, streamline registration processes, and enable digital overseas registrations, ensuring equal legal rights for all couples, regardless of gender, the Public Relations Department shared on Monday (20 January 2025).
Led by Minister of Interior Anutin Charnvirakul, the Ministry of Interior has completed preparations for the law’s rollout, including:
- Personnel training
- System upgrades
- Regulatory adjustments
To celebrate the milestone, the ministry will host the "Gong of Triumph for All Loves Across 878 Districts" ceremony in Kathu district, Phuket. The event will feature:
- Same-sex marriage registrations
- Cultural performances
- Legal clinics to educate the public about the new law
The law outlines specific eligibility criteria for marriage registration:
- Both parties must be at least 18 years old
- Must be free from prior marital ties
- Cannot share a biological or adoptive family relationship
- Women who are widowed or divorced must wait 310 days before remarrying unless specific conditions are met
Required documents include:
- National ID cards
- Passports
- Marital status certificates
- Two witnesses aged 18 or older
Couples can register their marriages at:
- District offices
- Municipal offices
- Thai embassies and consulates
On-site registrations will be free, while off-site registrations will cost THB200. Spouses will gain equal rights and responsibilities, including mutual support obligations, joint management of assets, inheritance rights, and eligibility for tax deductions and survivor benefits.
